Q: I have obtained a judgment against someone in a court of law, how do I collect on it?

A: Tennessee law offers several different avenues for collecting on a final judgment. Your options may include levying the debtor’s bank account(s) or property, garnishing the debtor’s paycheck or even placing a lien on the debtor’s real property. If you do not know what assets a debtor may own, it may be necessary for you to file and have served on the debtor a “Subpoena in Aid of Execution” which would give you the opportunity to question the debtor under oath specifically about his/her/its assets. Also, keep in mind that certain property is exempt from collection. Considering the various issues involved with collection, you should speak with a lawyer concerning your particular situation.
