Q: Am I liable for injuries that a trespasser sustains on my property?

A: Maybe. A trespasser is generally protected only against willful or reckless conduct by the owner or occupant of property. However, if you as the owner or occupant know of entry on the land, you must use reasonable care to warn trespassers of any known danger that is not obvious. Furthermore, owners of attractive nuisances (i.e. swimming pools, playgrounds, etc.) owe a duty of reasonable care to either eliminate the potential danger of the attractive nuisance or otherwise protect children that may trespass onto the property.
